Please read the following terms and conditions of use carefully before using this website or purchasing any product. These Terms and Conditions (the "Terms") constitute a binding legal agreement between you ("you", "your", or "Customer") and ANO Trading LLC, a Florida limited liability company with its principal place of business in Doral, Florida, doing business as "iHeartCigars" ("iHeartCigars", "we", "us", or "our"). By accessing, browsing, or using this website (the "Site"), creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use this Site and do not purchase any products from us.

These Terms contain a binding individual arbitration agreement and class action waiver (Section 19) that affect your legal rights. Please read them carefully.

 

1. Age Restriction and Legal Capacity

I certify that I am of the legal smoking age to purchase cigars and other tobacco products in my jurisdiction, and in all events at least 21 years of age.

iHeartCigars does not knowingly sell tobacco products to any person under the age of 21, or under the minimum legal age to purchase tobacco in the customer's local jurisdiction, whichever is higher. You represent and warrant that:

•         You are at least 21 years of age (or the minimum legal age in your jurisdiction, whichever is higher);

•         You are legally permitted to purchase, receive, and possess tobacco products in your jurisdiction;

•         You are purchasing products for your own personal use and not for resale or redistribution to any minor;

•         All information you provide (including age, name, address, and identification) is true, accurate, and complete.

It is unlawful in many jurisdictions to misrepresent your age in order to purchase tobacco products. We reserve the right to request and verify proof of age at any time, to refuse any order, and to cancel any order where age cannot be verified to our satisfaction. Any adult signature required at delivery must be provided by a person 21 years of age or older.

Please leave this Site immediately if you are under the applicable minimum age.

 

2. Independent Reseller Disclosure

iHeartCigars is an independent reseller. We are not an authorized dealer, distributor, agent, or representative of any cigar manufacturer, brand owner, or trademark holder whose products are offered on this Site, and we are not endorsed, sponsored, or approved by any such party. Products sold on this Site may be sourced through international or secondary distribution channels outside the manufacturer's authorized distribution network for the United States or any other country.

You expressly acknowledge and agree that:

(a) Products purchased from iHeartCigars do not carry any manufacturer's warranty, express or implied, and are not eligible for any manufacturer service, replacement, recall, refund, authentication, or customer support program;

(b) Product packaging, warnings, labeling, tax stamps, serial numbers, bands, boxes, seals, codes, or accompanying materials may differ from products sold through a manufacturer's authorized channels in your jurisdiction, and may be in languages other than English;

(c) Products may have been produced, packaged, or distributed for sale in markets outside the United States and may differ in formulation, blend, presentation, or quality-control standards from equivalent products sold through authorized channels;

(d) The legality of importing, receiving, possessing, or reselling certain products may vary by jurisdiction, and you are solely responsible for determining and complying with all laws applicable to your purchase, importation, receipt, and possession of the products, including but not limited to any prohibitions on Cuban-origin tobacco products under United States law, sanctions regulations, customs and excise laws, and state and local tobacco laws;

(e) We make no representation that products are authorized for sale, importation, or distribution in any particular jurisdiction, and shipments may be subject to seizure, forfeiture, or destruction by customs or other governmental authorities, for which we shall have no liability except as expressly stated in Section 7;

(f) All trademarks, service marks, trade names, logos, and brand names appearing on the Site or on products are the property of their respective owners, used solely for lawful nominative identification purposes under applicable fair-use principles; nothing on this Site shall be construed as granting any license or right to use any such mark.

 

3. No Manufacturer Warranty; "As-Is" Sale

Because iHeartCigars is a foreign import retailer, all products are sold "as is" and "with all faults." To the fullest extent permitted by law, iHeartCigars disclaims all warranties of any kind with respect to the products, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, authenticity, origin, quality, condition, conformity to sample or description, and any warranties arising from course of dealing, course of performance, or usage of trade.

No oral or written information, statement, representation, product image, tasting note, strength rating, flavor description, review, or advice given by iHeartCigars or any of its employees, agents, affiliates, or suppliers shall create any warranty or expand the scope of these disclaimers. Tasting notes, flavor descriptions, strength ratings, reviews, and editorial content are subjective opinions only and are not representations about the actual characteristics of any product you receive.

Cigars and other tobacco products are agricultural, handmade products subject to natural variation in color, size, weight, wrapper appearance, draw, burn, construction, and flavor. Such variation is inherent to the product and does not constitute a defect.

Some jurisdictions do not allow the exclusion of certain implied warranties; in those jurisdictions, the foregoing exclusions apply to the maximum extent permitted by law.

 

4. Prop 65 and State Health Warnings

Warning: Tobacco smoke, including cigar smoke, contains chemicals known to the State of California to cause cancer, birth defects, and other reproductive harm. Additional warnings may apply under the laws of other states. Use of tobacco products, including cigars, is hazardous to your health and may cause cancer, heart disease, and other serious diseases, including in non-smokers. These Terms do not waive, and nothing on this Site is intended to waive, any non-waivable consumer-protection or health-disclosure rights.

 

5. Orders, Acceptance, Pricing, and Typographical Errors

All orders placed through the Site are offers by you to purchase products subject to these Terms. No order is binding on iHeartCigars until we accept it. We may, in our sole discretion, accept, decline, cancel, or limit any order, in whole or in part, at any time and for any reason, including but not limited to: product unavailability; errors in pricing, images, descriptions, or inventory; suspected fraud; suspected resale or redistribution; inability to verify age or identity; shipping restrictions in your jurisdiction; or violation of these Terms.

Prices are listed in U.S. dollars and are subject to change without notice. Prices do not include taxes, duties, tariffs, or shipping charges unless expressly stated. In the event a product is listed at an incorrect price or with incorrect information due to typographical, photographic, technical, or pricing errors, we reserve the right to refuse or cancel any order placed for product listed at the incorrect price or information, whether or not the order has been confirmed and your payment method charged. If your payment method has been charged and the order is cancelled, we will issue a refund to the same payment method in the amount charged.

An order confirmation email is an acknowledgment of receipt of your order and is not acceptance of the order. Acceptance occurs upon shipment.

 

6. Payment

You represent and warrant that you are authorized to use the payment method you provide and that the payment information you supply is true, accurate, and complete. You authorize us and our payment processors to charge your payment method for the total amount of your order, including taxes and shipping. If your payment method is declined or cannot be processed for any reason, we may cancel your order. You agree to reimburse us for any chargeback, reversal, or fee we incur as a result of unauthorized, fraudulent, or invalid payments initiated through your account or payment method.

 

7. Shipping, Delivery, Risk of Loss, and Customs

Shipping carrier and method are selected by iHeartCigars unless otherwise agreed in writing. Estimated delivery times are estimates only and are not guaranteed.

Title and risk of loss for all products pass to you upon our delivery of the products to the common carrier at our facility (FCA/shipper's facility). Once a shipment leaves our facility, all risk of loss, damage, theft, seizure, delay, misdelivery, non-delivery, or destruction of the product is borne by you, except to the extent caused by our gross negligence or willful misconduct.

Adult signature. Tobacco shipments may require the signature of a person 21 years of age or older at delivery. If no qualifying adult is available, the carrier may return, hold, or dispose of the shipment in accordance with its policies, and you will remain responsible for all charges.

International, interstate, and restricted shipments. You are solely responsible for:

•         Determining whether the products you order may lawfully be imported into and received in your jurisdiction;

•         Payment of all duties, customs fees, import taxes, excise taxes, tariffs, broker fees, and other governmental charges;

•         Compliance with the Prevent All Cigarette Trafficking Act (PACT Act) and all analogous federal, state, local, and foreign laws;

•         Compliance with any jurisdiction-specific restrictions, licensing requirements, or prohibitions (including, without limitation, state-level flavored-tobacco bans, online-sale bans, or Cuban-origin tobacco prohibitions).

We may decline to ship to any jurisdiction at our sole discretion. We assume no liability for products seized, detained, destroyed, returned, or taxed by any customs, postal, or governmental authority, and no refund will be issued for products lost due to such seizure, detention, destruction, or return, nor for products returned to us by a carrier due to an invalid address, refused delivery, or failure to comply with adult-signature requirements.

Shipping losses and damages not caused by customs or governmental action must be reported to us in writing within three (3) calendar days of the carrier's recorded delivery or attempted delivery date, accompanied by photographs and any other evidence we reasonably request. Failure to report within this period waives all claims.

 

8. Returns, Refunds, and Cancellations

Because tobacco products are perishable, consumable, and regulated, and because iHeartCigars is a foreign import retailer with no manufacturer return privileges, all sales are final. We do not accept returns or exchanges of opened, used, consumed, or altered product under any circumstances.

Unopened product may be considered for return or exchange only at our sole discretion, only if (a) the return is requested in writing within seven (7) calendar days of delivery, (b) the product is unopened with all original seals, bands, cellophane, packaging, and documentation intact, and (c) the customer receives a written Return Merchandise Authorization (RMA) from us before shipping the product back. Returns shipped without an RMA will be refused. The customer bears all return shipping costs and risk of loss on returns. We reserve the right to charge a restocking fee of up to twenty-five percent (25%) and to deny any return that does not comply with this policy.

Order cancellation. Orders may be cancelled by the customer only prior to shipment. Once an order has been tendered to the carrier, it cannot be cancelled.

Refunds, when granted, will be issued to the original payment method and may exclude original shipping costs, payment-processing fees, and restocking fees.

 

9. Site Content, Copyright, and License

The entire content of this Site, including all text, graphics, photographs, video, audio, product descriptions, tasting notes, reviews, user interfaces, visual interfaces, software, code, and the selection, coordination, arrangement, and organization thereof (collectively, the "Site Content"), is the property of ANO Trading LLC or its licensors and is protected by United States and international copyright, trademark, trade-dress, and other intellectual-property laws. Third-party trademarks appearing on the Site remain the property of their respective owners and are used solely under nominative fair use for product identification.

We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site and to electronically copy and print reasonable portions of the Site Content solely for your personal, non-commercial use in placing an order with us or purchasing our products. Any other use — including reproduction, distribution, display, transmission, scraping, harvesting, framing, mirroring, data mining, training of any artificial-intelligence or machine-learning model, creation of derivative works, or commercial use — is strictly prohibited without our prior written consent. You may not remove or alter any proprietary notice. Nothing on the Site confers, by implication, estoppel, or otherwise, any license or right to use any trademark without our or the trademark owner's prior written permission.

 

10. User Conduct

You agree not to, and not to attempt to:

(a) Use the Site in violation of any law, regulation, or these Terms;

(b) Harass, abuse, threaten, impersonate, or defame any person, including iHeartCigars staff, other users, or third parties;

(c) Upload, post, transmit, or otherwise make available any content that is unlawful, defamatory, obscene, pornographic, threatening, invasive of privacy or publicity rights, infringing, or otherwise objectionable;

(d) Use the Site to solicit business, distribute advertising, or recruit users to competing services;

(e) Attempt to circumvent, disable, or interfere with security-related features, age-verification measures, rate limits, or usage restrictions;

(f) Use any automated means (including bots, crawlers, scrapers, or AI/LLM training tools) to access the Site or collect Site Content, except for publicly accessible search-engine indexing in accordance with our `robots.txt`;

(g) Use the Site to facilitate the sale of tobacco to minors or to redistribute products in violation of any law;

(h) Reverse-engineer, decompile, or disassemble any portion of the Site.

We may, in our sole discretion, investigate and take legal action against anyone who violates these Terms, including removing content, suspending or terminating accounts, and reporting violations to law-enforcement authorities.

 

11. User-Generated Content

If you submit reviews, comments, photographs, suggestions, or other materials (collectively, "User Content") to the Site, you grant iHeartCigars a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display the User Content in any media, in connection with our business. You represent and warrant that you own or have all necessary rights to grant this license and that the User Content does not violate these Terms or any third-party rights.

We are not obligated to pre-screen User Content and act only as a passive conduit for its distribution, but we reserve the right (without obligation) to remove or block any User Content at our sole discretion.

 

12. Privacy

Your use of the Site and your purchases are subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices regarding personal information.

 

13. Third-Party Links and Services

The Site may contain links to websites, services, or resources operated by third parties. We do not control, endorse, or assume any responsibility for any third-party site, service, or resource. Your use of any third-party site or service is at your own risk and is governed by the terms and privacy policies of that third party. The inclusion of any link does not imply endorsement.

 

14. Disclaimer of Warranties

The Site and all Site Content, services, and products provided through the Site are provided "as is" and "as available," without warranty of any kind. To the fullest extent permitted by law, iHeartCigars and its officers, directors, members, managers, employees, agents, affiliates, licensors, and suppliers (collectively, the "iHeartCigars Parties") disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, authenticity, accuracy, and quiet enjoyment.

The iHeartCigars Parties do not warrant that: (a) the Site will be uninterrupted, secure, or error-free; (b) defects will be corrected; (c) the Site or the servers that make it available are free of viruses or other harmful components; or (d) Site Content, product descriptions, prices, ratings, or availability are accurate, complete, reliable, current, or error-free.

Some jurisdictions do not permit the exclusion of certain warranties; in those jurisdictions, the foregoing exclusions apply to the maximum extent permitted by law.

 

15. Limitation of Liability

To the fullest extent permitted by law:

(a) In no event shall the iHeartCigars Parties be liable to you or any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages (including without limitation damages for lost profits, lost revenue, lost data, loss of goodwill, business interruption, personal injury, emotional distress, or property damage), arising out of or in connection with the Site, any product, any Site Content, or these Terms, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not iHeartCigars has been advised of the possibility of such damages.

(b) The total aggregate liability of the iHeartCigars Parties arising out of or relating to the Site, any product, any Site Content, or these Terms, from all causes of action and under all theories of liability, shall not exceed the lesser of (i) the total amount you paid to iHeartCigars for the specific product or transaction giving rise to the claim during the ninety (90) days immediately preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars (US$100).

(c) You assume all risk associated with the purchase, possession, consumption, and use of tobacco products, including without limitation health risks, addiction, legal risk, and risks relating to the foreign import nature of the products.

(d) The limitations in this Section 15 apply even if any limited remedy fails of its essential purpose, and form an essential basis of the bargain between you and iHeartCigars. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in full; in such jurisdictions, the iHeartCigars Parties' liability is limited to the greatest extent permitted by law.

 

16. Assumption of Risk

You acknowledge that tobacco use is dangerous and addictive. By purchasing and using products sold on the Site, you voluntarily and knowingly assume all risks associated with tobacco use, including without limitation health risks, addiction, fire and burn risks, and risks to yourself, your property, and third parties. You waive and release iHeartCigars from any claim related to such risks to the fullest extent permitted by law.

 

17. Indemnification by Customer

You agree to defend, indemnify, and hold harmless the iHeartCigars Parties from and against any and all claims, demands, actions, suits, proceedings, liabilities, losses, damages, judgments, settlements, fines, penalties, costs, and expenses (including reasonable attorneys' fees, court costs, and expert fees) arising out of or relating to:

(a) Your breach of these Terms or any representation or warranty you made in these Terms;

(b) Your purchase, importation, receipt, possession, use, consumption, resale, or redistribution of any product;

(c) Your violation of any law, regulation, or third-party right (including any trademark, copyright, privacy, or publicity right), whether in your jurisdiction of residence, the jurisdiction of delivery, or any jurisdiction through which the product transits;

(d) Any claim arising from the foreign import nature of any product, including but not limited to claims relating to authenticity, authorized distribution, warranty coverage, manufacturer support, tax stamps, labeling, recalls, or customs compliance;

(e) Any claim brought by a minor, or by a parent or guardian of a minor, relating to product sold to an account you opened or a payment method you provided;

(f) Any misrepresentation you made regarding age, identity, shipping address, intended use, or eligibility to receive tobacco products;

(g) Any User Content you submit;

(h) Any negligent or wrongful act or omission by you or any person using your account.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate in asserting any available defenses. You shall not settle any matter affecting the iHeartCigars Parties without our prior written consent.

 

18. Force Majeure

iHeartCigars shall not be liable for any delay in or failure of performance caused by events beyond its reasonable control, including without limitation: acts of God; fire; flood; earthquake; hurricane; pandemic, epidemic, or public-health emergency; war; terrorism; civil unrest; strikes or labor disputes; shortages of materials or transportation; carrier delays or failures; supplier failures; governmental actions, orders, embargoes, sanctions, customs seizures, or changes in law; utility, internet, or payment-processor outages; or cyberattacks.

 

19. Dispute Resolution — Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.

19.1 Informal Resolution. Before initiating any arbitration or small-claims action, you agree to contact us at the email address posted on the Site and provide a written description of the dispute, the relief requested, and your contact information. The parties will attempt in good faith to resolve the dispute informally for at least thirty (30) days before either party may initiate arbitration.

19.2 Binding Arbitration. Except as stated in Section 19.5, any and all disputes, claims, or controversies arising out of or relating to these Terms, the Site, or any product purchased from iHeartCigars — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory — shall be resolved exclusively through final and binding individual arbitration, and not in court, and not as a class, collective, consolidated, or representative action.

19.3 Arbitration Administration. The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect (the "AAA Rules"), which are available at www.adr.org. The arbitration shall be conducted by a single neutral arbitrator. The seat of arbitration shall be Miami-Dade County, Florida, unless you and iHeartCigars agree otherwise or the arbitrator determines that a different location is required by the AAA Rules or applicable law. Arbitration may be conducted in person, by telephone or video, or based on written submissions, at the arbitrator's discretion and subject to the AAA Rules. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

19.4 Class Action Waiver. You and iHeartCigars agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, private attorney general, or representative action or proceeding. Unless both you and we agree in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable with respect to any claim for public injunctive relief, that claim (and only that claim) shall be severed and may proceed in court after all other claims between the parties have been finally resolved in arbitration.

19.5 Exceptions. Either party may (a) bring an individual action in small-claims court for disputes within that court's jurisdiction, in lieu of arbitration; (b) seek temporary injunctive or equitable relief in a court of competent jurisdiction to prevent or stop the infringement, misappropriation, or violation of its intellectual-property rights; and (c) file suit to enforce an arbitration award.

19.6 Governing Law and Forum for Non-Arbitrable Claims. These Terms and any dispute arising hereunder are governed by the laws of the State of Florida, without regard to its conflicts-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. To the extent a dispute is not subject to arbitration and is not filed in small-claims court, the parties irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida, and waive any objection to such jurisdiction or venue.

19.7 Jury-Trial Waiver. To the fullest extent permitted by law, you and iHeartCigars waive the right to trial by jury in any action, proceeding, or counterclaim arising out of or relating to these Terms.

19.8 Time Limit. Any claim arising out of or relating to these Terms, the Site, or any product must be commenced within one (1) year after the claim accrues, regardless of any statute or law to the contrary. A claim that is not commenced within that period is permanently barred. This limitations period may not apply to the extent prohibited by applicable law.

19.9 Opt-Out. You may opt out of this Section 19 (arbitration and class-action waiver only; the rest of these Terms will remain in effect) by sending written notice of your decision to opt out, including your name, address, order number, and a clear statement that you wish to opt out of Section 19, to iHeartCigars at the email address posted on the Site, within thirty (30) days of your first acceptance of these Terms. Opt-out notices submitted after the thirty-day period are not effective.

 

20. Term and Termination

These Terms apply to you upon your first access to the Site or first purchase and continue until terminated. We may terminate, suspend, or restrict your access to the Site, your account, or any order, at any time, for any reason or no reason, with or without notice. Upon termination, Sections 2–4, 7 (for pending shipments), 8–11, 13–19, and 21 shall survive.

 

21. Miscellaneous

21.1 Entire Agreement. These Terms, together with the Privacy Policy and any written order confirmation, constitute the entire agreement between you and iHeartCigars regarding the Site and the products, and supersede all prior or contemporaneous agreements, communications, and proposals.

21.2 Amendments. We may modify these Terms at any time by posting the revised Terms on the Site with a new "Last updated" date. Material changes will be effective upon posting. Your continued use of the Site or placement of any order after posting constitutes your acceptance of the revised Terms.

21.3 Severability. If any provision of these Terms is held invalid or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect. The class action waiver in Section 19.4 is not severable from the arbitration agreement, except as expressly stated in Section 19.4.

21.4 No Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision. No course of conduct or usage of trade shall modify these Terms.

21.5 Assignment. You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. iHeartCigars may assign these Terms, in whole or in part, to any affiliate, successor, or acquirer, without notice to you.

21.6 No Third-Party Beneficiaries. Except for the iHeartCigars Parties (who are intended third-party beneficiaries of Sections 14, 15, 17, and 19), these Terms do not confer any rights on any person or entity that is not a party hereto.

21.7 Notices. We may deliver notices to you by email to the address associated with your account, by a general notice on the Site, or by any other reasonable method. You shall send notices to iHeartCigars via the contact information posted on the Site.

21.8 Relationship of the Parties. Nothing in these Terms creates any partnership, joint venture, agency, employment, or fiduciary relationship between you and iHeartCigars.

21.9 Headings. Section headings are for convenience only and do not affect interpretation.

21.10 Electronic Communications and Signatures. You consent to receive communications from us in electronic form and agree that electronic agreements, notices, disclosures, and other communications satisfy any legal requirement that such communications be in writing. Your use of the Site and placement of an order constitutes your electronic signature and acceptance of these Terms.

21.11 Export and Sanctions Compliance. You represent that you are not located in, under the control of, or a national or resident of any country subject to U.S. economic sanctions, and that you are not on any U.S. government list of prohibited or restricted parties.

21.12 Company Information. iHeartCigars is a trade name of ANO Trading LLC, a Florida limited liability company. All questions regarding these Terms should be directed to the contact information posted on the Site.

 

By using this Site or placing an order, you acknowledge that you have read, understood, and agreed to these Terms and Conditions, including the binding arbitration agreement and class action waiver in Section 19.
